In 1955, U.S. Secretary of State John Foster Dulles, co-author of the San Francisco Peace Treaty, confirmed that the Taiwan Treaty had not yielded to anyone. According to him, Japan has “renounced only sovereignty over Taiwan.” [33] Dulles stated that America “cannot therefore accept that Taiwan`s provision is merely an internal problem for China.” [33] This legal justification is rejected by both the PRC government and the ROC government, both of which base their rights over Taiwan on Japan`s surrender instrument, which accepts the Potsdam Declaration and the Cairo Declaration.
